JOEL M. KOZBERG, OF COUNSEL

Mr. Kozberg has nearly 40 years of experience representing a diverse clientele in complex business litigation matters. He began his career at Stroock & Stroock & Lavan, where he became a partner. There, his representations typically involved the defense of large corporate clients in business litigations. In 1995, Mr. Kozberg became a member of Gradstein, Luskin & Van Dalsem and transformed his practice to add the representation of plaintiffs in complex business actions. In 2005, Mr. Kozberg formed Kozberg & Bodell LLP, where he continues to represent both plaintiffs and defendants in complex business matters. Mr. Kozberg is AV rated by Martindale Hubbell and has been selected as a Southern California SUPER LAWYER each year during 2005-2019. He has a proven record in handling complex matters in both trial and appellate courts.

Mr. Kozberg's Notable Representations:
Obtained a jury verdict of over $2 million in an accounting malpractice case, with a 12/0 finding by the jury that Coopers & Lybrand had acted with malice, oppression and fraud. The action settled on a confidential basis the morning of the punitive damage phase of the trial.
Obtained a $1 million settlement in a breach of fiduciary duty action by an entertainment personality against his business manager.
Obtained a $22 million settlement in an individual securities fraud action against a Fortune 200 company that had engaged in accounting fraud. The amount of the settlement exceeded the client's out-of-pocket losses.
Obtained a $2.5 million settlement in an accounting fraud cases against a Fortune 500 company. Settlement fully compensated client for all losses.
Represented the founder of an independent oil company and gas company in litigation against his fellow shareholders, including affiliates of Enron, following their decision to terminate him as company CEO. The claims asserted on behalf of the client included wrongful termination and breach of fiduciary duty. The claim resulted in confidential settlement that included a substantial monetary payment as well as the acquisition of control of the company by the client.
Obtained settlements of over $30 million on behalf of a surety insurer that was the victim of fraud by its MGA.
Obtained a settlement of in excess of $1.9 million on behalf the victim of a Ponzi scheme in an action against his bank and attorneys.
Represented a venture capital firm in an action for interference with contract against a party that caused the investment target to withdraw from its agreement to accept the investment. Client obtained jury verdict of $300 million in compensatory damages and $50 million in punitive damages.
Obtained $4.5 million settlement in attorney malpractice case against national law firm.
Obtained $5.2 million settlement in attorney malpractice case.
Obtained $6 million settlement in an interference with contract action related to the apparel industry.
Represented movie producer in an action against a joint venture partner for breach of contract to fund $400 million film production company. Obtained favorable confidential settlement.
Obtained substantial confidential settlement of attorney malpractice suit against major Los Angeles law firm arising out of over-billing and attorney malfeasance.
Represented an insurer that had issued the first layer of excess D & O liability insurance in a bad faith and coverage action that followed an attempted "Mary Carter" settlement by the insurers. The action was successfully settled with the insurer client paying less than the amount of its policy limit, even though the following layer of coverage paid its full policy limit.
